The high court has dismissed with costs a petition challenging the victory of Lutyeshe County Member of Parliament, Isaac Modoi. Modoi’s rival Godfrey Watenga ran to court accusing him of lack of the requisite academic qualifications for election as a member of parliament. The legislator garnered 9,990 votes against 9,304 votes polled by Watenga.
In his petition, Watenga accused Modoi of using someone’s academic documents to vie for election as MP. Watenga claimed that Modoi used the academic documents of Modoi Abdul Isaac for his nomination and subsequent election.
He also claimed that the elections were fraught with voter bribery and asked the court to annul Modoi’s victory and declare him the winner of the polls or order fresh elections. This morning, Justice Andrew Bashaija quashed the petition, saying that the said Modoi Abdul Isaac is the same Modoi Isaac who was nominated and elected as the MP for Lutyeshe county.
He explained that the legislator only used the names interchangeably during his advanced level examinations and university.
Modoi welcomed the court decision, saying that it has proved the petitioner wrong. He thanked his nemesis for bringing the matter to court such that the truth about his education come out clearly.
Watenga’s lawyer, Robert Mulana said that they will analyse the judgement before advising their client on their next course of action.
